Communication with Elders

With the increasing number of older people in the United States, it is vital for healthcare professionals to communicate effectively and respectfully with elders. Effective, appropriate communication with elders is important for many reasons. For psychotherapists and other healthcare professionals, communication is the foundation of service delivery. Communication is required for assessment of the person prior to treatment. Symptoms are, after all, subjective and must be reported by the person to the clinician. Effective communication also contributes to health literacy; the person’s understanding of her condition, treatment options, and the treatment plan to be followed. A person cannot comply with a treatment program unless the program is communicated clearly enough for the person to understand it. The more effective the communication, the more effective treatment will be – and the more cost effective. Communication also helps the clinician understand the whole person: the emotional, social, and financial realities that affect response to treatment and ability to comply.

Florida Mental Health Laws and RulesWhy study laws and rules (aside from the fact that our Florida licensure law requires it)? Don’t we already have multiple layers of laws, regulations, ethics and guidelines available to us from a variety of professional and regulatory sources? Furthermore, after engaging in professional practice over a number of years, don’t we pretty much know what to do and not do in most situations?

There are actually a number of fundamental reasons for psychotherapists to maintain familiarity with the laws and rules of the trade on an ongoing basis. Bottom line: awareness of laws and rules is good for your clients as well as good for you and good for your professional practice.

Florida Mental Health Laws and Rules is a new 3-hour online continuing education (CE/CEU) course that is approved to meet the requirements of a Florida Laws and Rules course as a license renewal requirement for Florida-licensed clinical social workers, marriage and family therapists, and mental health counselors. It is required every third biennium after initial licensure. Content of this course will include excerpts from the relevant Florida statutes and Administrative Code regulating the practice of social work, marriage and family therapy and mental health counseling, along with interpretive commentary and case examples. Included are Chapter 491 of the Florida Statutes – the practice act for these named professionals, Chapter 64B4 of the Florida Administrative Code – establishing the Board of Clinical Social Work, Marriage & Family Therapy & Mental Health Counseling, and selected sections from Chapters 39, 394, and 456 of the Florida Statutes. Emphasis is on those issues most important for practicing mental health clinicians in delivering ethical, legal, and competent professional services while attending to prudent risk management practices. The goal of this course is to make life easier for clinicians by presenting a brief summary of the relevant laws and rules of practice in the State of Florida, leading to an ever-increasing awareness of and conscious compliance with the particulars of those bodies of legislation. Continuing Education & License Renewal Requirements

OHCSWMFTThirty Clock Hours of continuing education are required for all license renewals every two years from the date of licensure. Three of the thirty hours must cover ETHICS. Ethics CEUs may or may not contain the word ethics in the title or description. Some CEUs cover ‘ethical subjects’ , such as: productivity, documentation, termination, HIPPA, boundary concerns, cultural diversity, human trafficking and some types of supervision.

Supervision:

  • LPCC-S & LPC-S counselors holding the supervising counselor designation must complete 3 hours of supervisory training per renewal cycle. This type of supervision needs to be focused on training that will help supervisor to help their supervisees (counselor trainees and clinical residents) to gain the experience required for licensure as a professional counselor or professional clinical counselor, and to improve their own skills as a supervising counselor. ref. 4757-9-02(A)
  • LISW-S holding the supervising designation must complete 3 hours of supervisory training per renewal cycle This type of supervision needs to be focused on training supervision of LSW’s working toward their two years of supervised practice or SWTs in their field work. TIP: supervision should contain content that includes the: supervisor, supervisee and the client. ref: 475709-03(D) / 4757-23-01 paragraph (E)(3)(b)
  • IMFT-S All supervising independent marriage and family therapists shall maintain supervisory status by obtaining five hours in an AAMFT approved supervision refresher course or equivalent supervision course every five years. ref. 4757-29-01 (F)(4)
